Negligence Liability in building collapses?

Now that a better building frame reinforcing system is available, and since this reinforcing meets and exceeds Construction Codes minimums, and that building Designers and Contractors are not adopting this reinforcing system, can they be sued for negligence in the event of a building collapse that would not have occurred with this new frame reinforcing?   1. Designers and contractors are liable for actual costs and damages in case of a collapse of a buildling if it is established in evidence presented that they are negligent in the construction by not following minimum requirements.
  2. something built in 1905, wont be held to the same standard of something built in 2005, for up-dates their all protected by time lines..........
